ORB 27 April 1995. The official referee limited the 9 defendant surveyors, accused of negligence in the valuation of 29 properties, to one expert each, and directed the parties to agree how each expert could incorporate any information as to local conditions outside their personnal knowledge in their evidence. The parties failed to agree, and the defendants renewed their applications to call an expert in respect of each of the properties. The plaintiff applied for appointment of a court valuation expert under RSC Ord 40. Plaintiff`s application allowed.
