In Proberun Ltd v SoS for the Environment and another, CA 15 May 1990, it was held that the proper test as to whether the submitted details met the requirements of the condition was whether the means of access was the best means. If the test is met the reserved matters should be approved. If the means of access cannot be achieved on the land to satisfy the highway authority, the remedy is the revocation of the planning permission or the use of the highway authority`s powers.
