CA 8 October 1992. The respondents G owned a language school. They applied for planning permission to change the use to offices. This was refused on two grounds; that the proposed use would detract from the residential character of surroundings and that it was contrary to the structure plan as it would lead to the loss of the property for potential residential use. G appealed, however this was dismissed by the SoS being in agreement with the council on the first point. G appealed again to the High Court this was upheld on the grounds that the original use of as language school was as damaging to the character of the area and the change of use would not cause any further damage. The SoS appealed and this was allowed in the grounds that there were no specific need for offices in the area whereas there had been a need for a language school.
