In R v East Hertfordshire DC ex parte Smith , a local authority fulfilled its statutory duty under Town and Country Planning Act 1971 s51 and Land Compensation Act 1973 s38 to rehouse people displaced from residential accommodation by a compulsory purchase order , if it secured temporary bed and breakfast accommodation pending discussion on permanent accommodation.
