"Smith and another v Mid Devon DC" ChD 9 December 1994. Two owners of properties of disparate value agreed to exchange, apparently to S`s benefit. When, however, it transpired that despite the answer given in the local authority search, vehicular access to a proposed car park was planned to cross the property, S sued the council for damages arising from the admitted negligence.
