In Blue Town Investments Ltd v Higgs and Hill plc , HC 10 January 1990, it was held that a development of blocks of flats which caused a nuisance to windows was not to be demolished or changed. The plaintiffs had not challenged the building early enough and were unwilling to pay the defendants damages.
