In Draper v Smith and others , CA 19 January 1990, the appeal was dismissed. The respondent landlords were entitled to serve a second section 25 notice . The respondent had not relied upon the first notice, which was invalid, and were entitled to withdraw it. The appellant had not waived the invalidity of the first notice and failed to make a second application to the county court in respect of the landlords` second notice, who were therefore entitled to possession .
