In Tower Hamlets LBC v Abadie , CA 17 January 1990, the appeal was allowed on the grounds that the appellant had an arguable case and the evidence supported his contention that he had a protected tenancy and although there had been a long delay before the appellant sought to set aside the judgement there was no prejudice to the respondents.
