In Hillingdon LBC v SoS for the Environment and another , QBD 18 January 1990, the appeal was dismissed. The inspector was entitled on the evidence before him and on the basis of the facts to decide that the works carried out were ` specified operations `. There was no flaw in the inspectors conclusions as to the developers intent; the work was not colourable in the manner contended by the council.
