ChD 29 October 1992; CA 18 December 1992. Application to ChD for an interlocutory injunction to restrain a nominated arbiter from proceeding with determination of a dispute referred to him pending a decision of the court on construction of a funding agreement was refused. The CA upheld the decision in refusing the plaintiff`s appeal to grant the injunction on the grounds that the Court does not have a discretion whether or not to grant a declaration in advance of an expert`s determination.
