In "Clarke Homes Ltd v SoS for Environment and another" CA 15 February 1993, upheld the SoS decision accepting the Inspector`s decision to refuse planning permission for residential development on the grounds that in the absence of a local plan, the interim planning structure was still evolving. Developer`s appeal dismissed.
