In "Agricultural Mortgage Corporation plc v Woodward and another" CA 19 May 1994, an action for repayment of sums due under mortgage, where a tenancy was granted by the mortgagor to wife to ensure that mortgagee did not get vacant possession. High Court granted wife leave to defend action to set aside tenancy. Appeal allowed.
