Looks at the question of high-lift crane passing through the airspace of neighbouring properties which can amount to trespass in common law. An aircraft however is not usually subject to trespass when it enters airspace above private property. Refers to Australian and English case law in order to distinguish between trespass and non-trespass discussing important implications for surveyors.
