The Rent Act 1977 allows certain persons to succeed to a tenancy of a dwelling-house on the death of the "original tenant" (a protected or statutory tenant). The surviving spouse is a person who can succeed in this way, but if there is no surviving spouse, a member of the original tenant`s family residing with him may be entitled to succeed. This article discusses the case Swanbrae v Elliott (See Abstract 37417) in which the circumstances in which a person can be said to "reside with" the tenant were considered.
