"Take Harvest Ltd v Liu and another" PC 9 March 1993 centred on a sale and leaseback agreement on premises in Hong Kong and an oral agreement on the tenants surrender of the tenancy. The landlord sought to rely on section 3 of the Conveyancing and Property Ordinance of Hong Kong which provides that no action should be brought upon any contract for the sale or disposition of land unless the agreement was in writing. Both appeals by the landlord and the tenant were held in part.
