In Saleh v Robinson , CA 23 February 1988, it was held that a requirement that a person pay a premium to a protected tenant prior to the tenant surrendering his tenancy so that a protected tenancy would be granted to the person who had paid the premium, was a requirement that the person pay the premium in order to be granted the protected tenancy under Rent Act 1977 s 119(1) . The requirement was therefore illegal and the payment could be recovered by the payer.
