"Christchurch BC v SoS for the Environment and another" QBD 17 March 1992. The inspector`s decision to grant planning permission for residential development on land, which otherwise could be a playing field was upheld. It was a matter for the inspector`s judgement to give only slight consideration to the councils`s resolution to halt development on open spaces until the local plan had been adopted. The inspector maintained that to refuse planning permission for one use on account of another use, there must be evidence that the land would be effectively used for this second use.
