A number of issues had to be determined in "Emslie and Simpson v Aberdeen DC" LT for Scotland 12 August 1992; validity of a notice to quit; a claim for loss of profits due to blight pre-dating vesting in the acquiring authority; a claim for the loss on extinguishment of business; a claim for bank charges on borrowings made necessary by poor trading due to the blighting effect of the scheme; a claim for business loss by a wholly-owned subsidiary of the claimants trading from the subject premises; and a claim for the expenses of the hearing.
