CA 21 December 1992. The appellant, F, took the assignment of a retail tenancy with an annual rent of £10,475. C terminated the tenancy but did not oppose F`s application for a new one. At county court a new rent of £36,098 was fixed but was contested by F on appeal, as was the interim rent. In CA new weight was given to expert opinion and comparable evidence, and the earlier decision to disregard the known removal of Sainsbury`s from adjoining premises was overturned. Held in F`s favour.
