In "Noble Organisation Ltd v Falkirk DC", Extra Division of Court of Session, upholding the decision of Lord Mayfield, found that in declining to determine a planning application as being `similar` to an earlier application, F had been right to consider the question in the light of the relevant planning considerations. Advice in a departmental circular could have no bearing on scope of the authority`s statutory duty.
