Reviews the two cases "Linden Gardens v Lenesta Sludge Disposals" and "St Martins Property Corporation Ltd v Sir Robert McAlpine and Sons Ltd" (WB2929-04) which addressed the problem of contractors, in breach of their contract, claiming to be relieved from paying substantial damages only because the other contracting party had no proprietary interest in the works at the time when the breach occurred.
