"Tesco Stores Ltd v SoS Environment and others" HL 11 May 1995 held that where a planning obligation offered by a developer underthe Town and Country Planning Act 1990 s106, as substituted by the Planning and Compensation Act 1991 s12, related to a development, it was a material consideration within s70(2) of the 1990 Act and regard should be had to it.
