In Stoke on Trent CC and Norwich CC v B&Q plc , 10 April 1990, the judge did not consider that this was an appropriate case for the exercise of his discretion to stay the proceedings. He therefore refused B&Q`s applications to strike out as an abuse of court actions brought against them to restrain them from trading on Sundays in contravention of Shops Act 1950 .
