Appeal by Plymouth & South Devon Co-operative Society Ltd (Y) against High Court refusal to grant an application for judicial review of a planning decision of the first respondent Plymouth CC relating to development sites in which second to fifth respondents had interest. "Newbury DC v SoS Environment" considered in determining the materiality of a s106 obligation. Held that P was entitled to treat all matters in the package of Community benefits as material considerations. Appeal dismissed.
