Proposed legislation on contaminated land includes provisions to tighten legal liability for water pollution caused by seepage from abandoned mines. It includes the transfer of reponsibility for policing water pollution to the environmental agencies and the removal of exemptions for abandoned mines. Case law considering the differences between `causing` and `knowingly permitting` is examined.
