In Griffiths v Renfree , CA 27 February 1989, it was held that where a tenant on a protected shorthold tenancy gave notice of termination but was unable to give vacant possession because his estranged wife remained in occupation, the tenant remained liable to pay rent as occupation by the wife is treated as occupation by the tenant himself.
