In White v Barnet LBC , CA 7 March 1989, it was held that the statutory tenant of a flat in a house is not "the person having control of the house" for the purposes of Housing Act 1985 s190 /s207. Therefore, for a house in disrepair the local authority may not serve a repair notice on a statutory tenant requiring execution of specified repair works.
