In Robbins v SoS Environment and others, HL 2 March 1989, it was held that the requirement in a repairs notice issued by a planning authority on the owner of a listed building to carry out such works as were reasonably necessary for the proper preservation of the building, in this case a windmill , referred to preservation of the building as it was when listed and not as it was when the notice was served.
