In "Whyfe v Michael Cullen and Partners and others", HL 10 November 1993, it was held that there was a triable issue where owners of a property company and solicitor were alleged to have conspired by fraudulent misrepresentation to induce potential tenants to accept leases containing trick clauses which would make it impossible for tenants to keep the leases for their full term.
