In De Rothschild and another v SoS Transport and another , CA 12 July 1988, it was held that when a challenge was made to the confirmation by the SoS of a compulsory purchase order, there were no special rules , beyond the conventional ones, to be applied, but, the SoS had to be satisfied that a compulsory purchase order was justified on its merits before he could properly confirm it.
