ChD 8 June 1994. Claim by plaintiff tenant Dong Bang Minerva (UK) Ltd (X) for damages against defendant landlord Davina Ltd (Y) for breach of statutory duty under the Landlord and Tenant Act 1988. X applied to Y to sublet part of its premises but on failing to win Y`s consent instigated this action. Y alleged that as X had failed to give any undertaking to meet any costs involved. Y was in breach of its statutory duty under the 1988 Act and should have reasonably been expected to given its conditional consent to sublet by August 1993.
