In "Handel and others v St Stephens Close Ltd" ChD 4 March 1993 landlord of a block of flats (S) informed tenants (H) that work to provide secure parking bays would be undertaken. Erection of these bays would enable S to let them to H. H argued that they already had a right to park on the private roads and the close in which the bays were to be built. H`s case was held.
