The law on privity of contract in instances where the assignee has become insolvent has been complicated by the case "Deanplan Ltd v Mahmoud" (1992). Under the Insolvency Act 1986 s252 no action may be taken against the debtor whilst an interim order is in place without permission from the courts. Discusses the effect of insolvency on a tenant`s defence against his landlord for a breach of covenant.
