In Record v Bell , ChD 5 October 1990, a prospective house purchaser who did not want to complete purchase sought to use the issue of side letters between the solicitors as a reason for not competing the exchange of contracts . The purchaser sought leave to defend, saying the contract was unenforceable because of its non- compliance with Law of Property (Miscellaneous Provisions) Act 1989 s2 .
