CA 28 May 1993. A clause in a lease granted under right to buy provisions of the Housing Act 1985 to pay a service charge linked to the RICS index was not void or unenforceable. Schedule 6 para 16a of the Housing Act 1985 entitles the local authority landlord to ensure in the lease that the tenant bears a reasonable cost of repairs.
