CA 13 July 1993. Planning permission was granted for the building of a farmhouse but an agricultural occupancy condition was attached. It was held that an enforcement notice against the occupiers, who did not comply with the condition, was not out of time since the condition did not relate to the building operation and therefore did not come under Town and Country Planning Act 1990 s172(4)(b).
