ChD 18 May 1993. At the time of the transfer of land it was agreed that on gaining planning permission the plaintiffs would pay the vendors a percentage of the increase in value. Having gained planning permission, this agreement came into effect and the plaintiffs claimed that the earlier valuation, before planning permission was gained, should include hope value.
