Toye v Kensington and Chelsea Royal LBC - 1994 - Estates Gazette (1994) 09 EG 186-189(4) .

LT 9 June 1993. A claim for compensation following refusal of planning permission for enlargement of a dwelling house. At issue was the determination of value after the proposed works; the claim was for £363,000. Both parties put forward their case. The compensating authority`s valuer`s case supported a compensation sum of £91,998. Decision: the compensation was £263,000, the practical approach of the claimant`s valuers was preferred to the theoretical approach of the compensating authority`s valuer.
