"First National Commercial Bank plc v Humberts (a firm)" CA 13 January 1995. F lent £2.6m to a developer, securing the loan on a lease valued by H to be worth £4.4m on completion of the project. When the developer failed, the security proved insufficient and F contended the true valuation should have been £2.7m and that it would not have advanced the money on that basis. F claimed that H had been negligent and issued a writ. H argued successfully at the hight court that the writ was barred by limitation and F appealed. Appeal allowed.
