LT 3 November 1993. The issue centred around the right of B and G to erect houses on land purchased under restrictive covenant and whether such a right amounted to a "practical benefit" as laid down within the covenant. Held, modification of the covenant would enable the applicants to erect not more than five detached dwelling houses using relevant positions and dimensions, which would not exceed granted planning permission dated 10 September 1990. Costs awarded to the successful applicants, to be paid by the objector.
