In Forestry Commission v Frost and another QBD 27 June 1989 the respondent failed to apply for a felling licence yet continued to fell trees on property for which he had a licence to use and occupy but on which he had no interest or estate. The word "anyone" had to be defined as referring to anyone under Forestry Act 1967 s 17 or anyone with interest or estate in the land under s10. Appeal allowed.
