"Rees v SoS Environment and another" QBD 11 October 1994. Planning permission was granted for a premises for retention of change of use to a coffee shop, provided use only took place between certain specified hours (condition 4). Alleged that use went beyond these hours and an enforcement notice was issued. R appealed stating orders of food could be taken between those hours but service and consumption could take place thereafer. Appeal dismissed.
