"R v Elmbridge BC, ex parte Wendy Fair Markets Ltd" QBD 12 October 1994. Planning permission was refused for a Sunday market each week. An enforcement notice was issued and appeals lodged. The site was designated green belt in the local plan but following a High Court challenge by the applicants, was deleted. A review by the county council reinstated the designation of green belt and planning and enforcement notices were dismissed. Local authority issued a stop notice requiring cessation of land use for markets under Town and Country Planning Act 1990 s183. Applicants sought a judicial review. Application dismissed.
