In Milton (Peterborough) Estates Company v Harris, ChD 28 February 1989, a claim for possession, rent arrears and mesne profits was allowed and the counterclaim dismissed on the grounds that on the evidence of the witnesses at the meeting in August 1987, the defendant was to be permitted to harvest the 1988 crops and was not granted a licence which for the purposes of Agricultural Holdings Act 1986 s2 would become a tenancy.
