In "Croydon LBC v Gladden and another" CA 7 February 1994 held that Town and Country Planning Act 1990 s187(b), as inserted by Planning and Compensation Act 1991 s3, was drawn on the statutory assumption that an actual as well as an intended breach of planning control could be restrained by injunction and the section therefore did not exclude grant of mandatory injunctions under it. Appeal by defendants against injunctions dismissed.
