In "Botross v Hammersmith and Fulham LBC", QBD 21 October 1994, it was held that proceedings for statutory nuisance under Environmental Protection Act 1990 s82(1) were criminal in nature and as such the court had jurisdiction to make orders for compensation under Powers of Criminal Courts Act 1973 s35 to those aggrieved by the nuisance.
