HL 31 October 1996. Concerns an agreement between Brent, the landlord L, and the tenants of a flat, Burrows B. B agreed to pay a weekly rent charge and reduce rent arrears by regular instalments after L had obtained a final order for possession. B failed to make the payments and L executed a warrant for possession. L appealed against a county court decision that B be reinstated. Appeal allowed since the agreement to allow B to remain did not create a tenancy but only deferred the possession order so long as B complied with the agreement.
