In "R v SoS Environment ex parte Kent CC", QBD 7 November 1994, it was held that where part of a footpath had been mistakenly designated on a a definitive map and statement for an area, there was no power under Wildlife and Countryside Act 1981 s53 for it to be deleted in its entirety.
