The plaintiff let a house on a monthly assured tenancy to the defendant on terms allowing for direct payment by the council`s housing benefit department (HBD). The defendant covenanted not to share occupation of the property. P served notice for arrears of rent. P refused rent tendered by the HBD in name of the cohabitee of tenant. Decision whether this refusal disabled the landlord from invoking mandatory ground for possession. Appeal by plaintiff allowed.
