CA 19 November 1996. Hackney LBC (H) was found guilty of a criminal offence under the Public Health Act 1936 Part III as a result of a local authority accommodation being found to be in a state prejudicial to health. The plaintiff (I) living in the premises, commenced civil proceedings against H for damages for ill-health resulting from the state of the premises. Damages were awarded, however, an appeal was allowed and I found to have no right to claim compensation.
